A Texas state appellate court has ruled that child welfare officials had no right to seize more than 400 children living at a polygamist sect’s ranch.

The Third Court of Appeals in Austin ruled that the grounds for removing the children were “legally and factually insufficient” under Texas law.

Child welfare officials removed the children on the grounds that the sect pushed underage girls into marriage and sex and trained boys to be grown-up predators.

The appellate court ruled the chaotic hearing held last month did not demonstrate the children were in any immediate danger, the only measure of taking children from their homes without court proceedings. The ruling came as judges were signing off on individual custody plans in San Angelo.

This week, a complex and controversial piece of legislation began to make its way through the British parliament. One of the provisions of the bill permits the creation of “savior siblings” — children created via in vitro fertilization (I.V.F.) to ensure their tissues will match those of a sick older brother or sister, in order that the new child could provide, say, a bone marrow transplant. (Conceiving a child the old-fashioned way doesn’t guarantee a tissue match.) Another is a reduction of the legal time-limit on abortion, which up to now has been 24 weeks.

May 22, 2008 — WASHINGTON – Hundreds of patients taking Pfizer’s anti-smoking drug Chantix have reported serious accidents, vision problems and heart trouble, researchers said.

Researchers at the nonprofit Institute for Safe Medication Practices and at Wake Forest University said they found hundreds of reported problems since the drug’s 2006 approval. They included blurred vision, dizziness, confusion and loss of consciousness.

Pfizer officials defended Chantix, saying the side effects are mentioned on the drug’s label. “When you’ve got the nicotine withdrawal along with Chantix, it’s just very difficult to tell what is causing it,” said Gretchen Dieck, a Pfizer senior vice president.

POL AIDE MAY BE DEPORTED

May 22, 2008 — A top aide to a Brooklyn lawmaker is in jail facing deportation to Jamaica because of a minor crime to which he pleaded guilty to 23 years ago. Ray Martin, chief of staff to City Councilwoman Letitia James, was busted by immigration agents last week.

Martin, 43, who has lived in the United States as a legal resident since 1977, was ordered to leave in 2001 after he failed to appear at a court hearing.

The hearing was prompted by immigration agents who checked Martin’s background and found the conviction stemming from a 1985 misdemeanor drug charge.

“He’s been an exemplary staff member and an exemplary member of the community,” James said.
